Article.

Occurred: Conjunction was omitted in Ch. 240, Acts of
1982. As to the cross-references, Title 4 of the
Health - Environmental Article were redesignated Title
21 of the Health - General Article in Ch. 306, of the
Acts of 1987. Corrections of the cross-references by
Michie Company in the 1987 Replacement Volume of the
Health - General Article are validated.

21-218.

(a) In this [section] SECTION, "antibiotic drug" means any
drug that:

(1)  Is intended for use by a human being;

(2)  Contains any quantity of a chemical substance or
the chemically synthesized equivalent of a chemical substance
that is produced by microorganisms; and

(3)  Can inhibit or destroy microorganisms in dilute
solution.

(b) (2) The authority under this subsection to conduct

extended inspections of the records of an establishment that

relate to prescription drugs does not include the authority to

inspect records of the establishment that relate to:

(v) Research information, other than
information that:

1.  Relates to a new drug or an antibiotic
drug and is subject to requirements for reporting and inspection
that are imposed by rules and regulations adopted under [§ 355(i)
or (j)] § 355(I) OR (K) or § 357(d) or (g) of the Federal Act; or

2.  Relates to any other drug and would be
subject to reporting or inspection under rules and regulations
adopted under [§ 355(j)] § 355(K) of the Federal Act.
