AN ACT concerning

St. Mary's County , Somerset, Worcester, and Wicomico Counties -
Hunting - Use of Artificial Lights

FOR the purpose of excluding St. Mary's County, Somerset,
Worcester, and Wicomico counties from the provision of law
that permits the casting of rays of artificial light from a
vehicle for certain purposes under certain circumstances.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(e)(2) (i) Except in Anne Arundel, Calvert, Carroll,
Allegany, Garrett, Kent, Caroline, Talbot, Dorchester, Queen
Anne's, Cecil, Frederick, ST. MARY'S, SOMERSET, and Washington,
WICOMICO, AND WORCESTER counties, a person may cast the rays of
an artificial light from a vehicle on woods, fields, orchards,
livestock, wild animals or birds for the sole purpose of
observing or photographing wildlife until 9:00 p.m.

(ii) If a person casts the rays of any
artificial light under this paragraph the person has the burden
of establishing that the person was doing so for the purposes of
observing or photographing wildlife.

(iii) If a person casting artificial light
under this paragraph or anyone with the person casting artificial
light has a firearm or bow in their possession the person shall
be presumed to be in violation of paragraph (1) of this

subsection.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
