SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 81 - Revenue and Taxes
412.
(a) The term "motor fuel" means any liquid, regardless of
its composition or properties, used to propel a motor vehicle.
(b) The term "commercial motor vehicle" means any of the
following vehicles that are propelled by motor fuel:
(1) A passenger vehicle that has seats for more than
14 passengers in addition to the driver;
(2) A truck tractor as defined in § 11-172 of the
Transportation Article;
(3) A truck having more than 2 axles;
(4) A truck with 2 axles operating in combination
with a freight trailer or semitrailer as defined in § 13-927(c)
of the Transportation Article, that has a registered or operating
gross combination weight that exceeds 40,000 pounds; or
(5) A motor bus as defined in subsection (g) of this
section.
(c) The term "motor carrier" means any person who operates
or causes to be operated any commercial motor vehicle on any
highway in this State.
(d) The term "highway" means the entire width between the
boundary lines of every way publicly maintained when any part
thereof is open to the use of the public for the purpose of
vehicular travel.
(e) The term "operations" means operation of all [such]
COMMERCIAL MOTOR vehicles whether loaded or empty, whether for
compensation or not for compensation and whether owned by or
leased to the motor carrier who operates them or causes them to
be operated.
