regulations, the person shall be debarred for any period
determined by the Board to be appropriate under the
circumstances.
(f) A person may not willfully make false statements that
any entity is or is not certified as a minority business
enterprise for purposes of this subtitle. Any person who
violates the provisions of this subsection is guilty of a
misdemeanor and upon conviction is subject to imprisonment for a
period of not more than 1 year, or a fine of not more than
$2,500, or both.
[(g) This subtitle shall have no further force and effect
after June 30, 1988; except that this subsection does not
preclude the prosecution after June 30, 1988 of any violation of
a provision of this subtitle which occurred on or before June 30,
1988.]

(a) (1) In this section the following words have the
meanings indicated.
(2) "Designated Department" means the University of
Maryland, the Departments of General Services and Transportation,
the Maryland Food Authority, the Maryland Stadium Authority, or
the Interagency Committee on Public School Construction, or, for
procurements specified under Title 3, Subtitle 4 of this article,
the Department of Budget and Fiscal Planning.
(3) "Minority business enterprise" means any legal
entity, other than a joint venture, organized to engage in
commercial transactions which is at least 51 percent owned and
controlled by one or more minority individuals, or a nonprofit
entity organized to promote the interests of the physically or
mentally disabled.
(4) "Minority individual" means a member of a
socially or economically disadvantaged minority group, which for
purposes of this subtitle includes Blacks (not of Hispanic
origin), Hispanics, American Indians, Alaska natives, Asians,
Pacific Islanders, women, and the physically or mentally
disabled.
(5) "Certification" means the determination, through
a procedure used by the Department of Transportation or
recommended by the State Minority Business Certification Council,
that a legal entity is a minority business enterprise for
purposes of this subtitle.
(b) (1) Each designated department, except the Department
of Transportation as to construction contracts; shall structure
its procedures for procuring supplies, services, construction,
