is likely to respond favorably to the programs and services
provided at Patuxent Institution, [and] (4) (IV) can be better
rehabilitated through those programs and services than by other
incarceration , . AND (5) IS NOT (2) "ELIGIBLE PERSON" DOES
NOT INCLUDE A PERSON WHO (I) IS SERVING 2 OR MORE SENTENCES OF
IMPRISONMENT FOR LIFE UNDER THE PROVISIONS OF ARTICLE 27, § 412
OF THE CODE AND (6) IS NOT , OR (II) IS SERVING 1 OR MORE
SENTENCES OF IMPRISONMENT FOR LIFE WHEN A COURT OR JURY HAS
FOUND, BEYOND A REASONABLE DOUBT, THAT ONE OR MORE AGGREVATING
AGGRAVATING CIRCUMSTANCES EXISTED UNDER THE PROVISIONS OF ARTICLE
27, § 413 OF THE CODE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

(Senate Bill 428)
AN ACT concerning
Crimes - Contracts for Compensation
FOR the purpose of requiring that certain contracts relating to
the reenactment of certain crimes be submitted to the
Attorney General; requiring that payments under those
contracts be submitted to the Attorney General; requiring
the Attorney General to notify a victim of a certain crime
that a certain contract has been submitted to the Attorney
General; providing for the establishment of an escrow
account by the Attorney General and for the payment of funds
from that account; providing for periods of limitations;
requiring' the Attorney General to publish a certain legal
notice after receiving funds under this section; prohibiting
the concealment of a certain contract and certain payments
under the contract; providing that certain actions by a
defendant are void as against public policy; establishing
the Maryland Victims of Crime Fund and providing a certain
method of funding the Fund; granting certain authority to
the Attorney General; providing for a certain civil penalty;
providing certain procedures; providing for the construction
of this Act; defining certain terms; and generally relating
to moneys owing to criminal defendants pursuant to contracts
relating to the reenactment of crimes.
