Ch. 123

LAWS OF MARYLAND

(11) Subject to the approval of the Board of Public
Works, borrow money from any source for any corporate purpose,
including working capital for its operations, reserve funds, or
interest, and to mortgage, pledge, or otherwise encumber the
property or funds of the Authority and to contract with or engage
the services of any person in connection with any financing,
including financial institutions, issuers of letters of credit,
or insurers;

(12)  Subject to the provisions of § 13-712 of this
subtitle, issue bonds under this subtitle;

(13)  [Subject to the approval of the Board of
Public Works, receive] RECEIVE and accept from any source,
private or public, contributions, gifts, or grants of money or
property AND INVEST THE FUNDS OR PROCEEDS IN WHOLE OR IN PART;

(14) Exercise all the corporate powers granted
Maryland corporations under the Maryland General Corporation Law;

(15)  Impose the tax authorized under the provisions
of Article 81, Section 402(e) and (f) of the Code; and

(16)  Do all things necessary or convenient to carry
out the powers granted by this subtitle.

13-711.

(a) (1) [Subject to annual appropriations and the
provisions of this subtitle, the] THE Authority may acquire in
its own name, by gift, [or] purchase, OR CONDEMNATION, any real
or personal property, or interests in property, necessary or
convenient to construct or operate any facility.

(2) THE AUTHORITY, WHEN ACQUIRING IN ITS OWN NAME ANY-
REAL OR PERSONAL PROPERTY, OR INTERESTS IN PROPERTY AS SPECIFIED
IN PARAGRAPH (1) OF THIS SUBSECTION, SHALL .FIRST ATTEMPT TO
ACQUIRE REAL OR PERSONAL PROPERTY BY MEANS OF NEGOTIATION AND
PURCHASE, EXCEPT AS PROVIDED IN PARAGRAPH (3) OF THIS SUBSECTION.

(3) IF THE AUTHORITY IS NOT ABLE TO ACQUIRE REAL OR
PERSONAL PROPERTY BY THE CONDITIONS SET FORTH IN PARAGRAPH (2) OF;
THIS SUBSECTION, THE AUTHORITY MAY EXERCISE THE POWERS OF
CONDEMNATION FOR PRIVATE PROPERTY, AS PROVIDED IN SUBSECTION (B)
OF THIS SECTION, IF APPROPRIATE.

(4) IF THE AUTHORITY DETERMINES THAT THE PROVISIONS
OF PARAGRAPHS (2) AND (3) OF THIS SUBSECTION ARE INAPPROPRIATE,
THEN THE AUTHORITY MAY EXERCISE THE POWERS OF CONDEMNATION FOR
PRIVATE PROPERTY, AS PROVIDED IN SUBSECTION (C) OF THIS SECTION.

(B) ANY CONDEMNATION AUTHORITY UNDER THIS SECTION SHALL BE:
