Ch. 11    LAWS OF MARYLAND

400A.

It is unlawful for any person under the age of 21 years to
have in his possession, or under his charge or control, any
alcoholic beverage [other than beer or light wine as defined in
Article 2B of the Annotated Code of Maryland, and for any person
not designated under Article 2B, § 2(t)(2) of the Code to have
beer or light wine], unless the person is a bona fide employee of
the license holder, as defined in Article 2B, and has in his
possession, or under his charge or control, alcoholic beverages
during regular working hours and in the course of his employment.

DRAFTER'S NOTE: This deletes obsolete provisions in Article
27, §§ 400(a) and 400A.                                   

The provisions, relating to the possession of beer and
light wine by persons under the age of 21 and
misrepresentation by those persons to obtain beer and
light wine, became obsolete on July 1, 1985 when the
phase-out of the 18-year-old drinking, age, became
effective pursuant to Chs. 90 and 96 of the Acts of
1982.

The obsolete provisions were noted by the Harford
County Liquor Board.

418B.

(a)  Any person who as actor, dancer, owner, manager,
producer, director or agent or in any other capacity, prepares,
gives, directs, presents, performs or participates in any obscene
performance, exhibition, drama, play, show, dancing exhibition,
tableau, or entertainment in which live persons perform or
participate in an obscene manner in the presence of any other
person or persons who have paid a consideration of any type
whatsoever to observe the exhibition or performance[; and] SHALL
BE GUILTY OF A MISDEMEANOR AND ON CONVICTION SHALL BE FINED OR
IMPRISONED ACCORDING TO THE PENALTY SET FORTH UNDER § 42 4 OF THIS
ARTICLE.

(b)  Every owner, lessee, or manager of any theatre, garden,
building, room, place or structure, who knowingly permits the
same to be used for the purpose of any such exhibition as
enumerated in paragraph (a) [hereof] OF THIS SECTION, or who
assents to its use for any such purpose shall be guilty of a
misdemeanor and [upon] ON conviction [thereof] shall be fined or
imprisoned according to the penalty set forth [in § 424 of
Article 27] UNDER §424 OF THIS ARTICLE.

DRAFTER'S NOTE: This corrects stylistic errors and
antiquated language in Article 27, § 418B(a) and (b).
