Ch. 54                                    LAWS OF MARYLAND

(2) The Secretary of Health and Mental Hygiene shall
adopt rules and regulations for religious exemptions under this
subsection.

Article - Health - General

18-403.

(a)  Unless the Secretary declares an emergency or disease
epidemic, the Department may not require the immunization of an
individual if:

(1)  The individual objects to immunization because it
conflicts with the individual's bona fide religious beliefs and.
practices; or

(2)  The individual is a minor and the individual's
parent or guardian objects to immunization because it conflicts
with the parent or guardian's bona fide religious beliefs and
practices.

(b)  The Secretary shall adopt rules and regulations for
religious exemptions under this section.

(c)  The Department shall report to the General Assembly
EVERY 2 YEARS by January 1, [1987] BEGINNING IN 1989, the number
of exemptions granted and the incidence of diseases covered by
the immunization requirement within the exempt population and the
population as a whole.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1983. [It shall remain in effect for a period

of 2 years and, at the end of June 1987, with no further action

required by the General Assembly, this Act shall be abrogated and

of no further force and effect and shall be removed from the
Annotated Code of Maryland.]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
