AN EMERGENCY ACT:

(1)  to establish a trust for the benefit of members of the
Employees' Retirement System;

(2)  to establish a board of investment trustees to
administer the trust and otherwise make effective the
investment provisions of the Employees' Retirement
System Article;

(3)  to clarify the administrative responsibilities of the
chief administrative officer with respect to the
Employees' Retirement System;

(4)  to clarify the method for determining the county's
contribution to the Employees' Retirement System;

(5)  to provide for payment of expenses of the Employees'
Retirement System from the assets of the System;

(6)  to exempt all procurements made for the Employees'
Retirement System from the provisions of Chapter 11B of
the Montgomery County Code; and

(7)  to generally amend the provisions regarding the
Employees' Retirement System.

By repealing

Sections 33-36(d), 33-39A(a)(5), and 33-50 of the Montgomery
