responsibility of establishing local Emergency Planning
Committees; and
WHEREAS, Said Emergency Response Commission shall have the
responsibility to receive and distribute certain material
safety data sheets, hazardous chemical inventories, and
toxic chemical release forms, to be submitted by certain
described facilities; and
WHEREAS, Under Article 16A, Section 5 of the Annotated Code of
Maryland there is established an Emergency Management
Advisory Council, to advise on emergency management and
civil defense matters, including planning and coordination;
and
WHEREAS, The function of the Emergency Management Advisory
Council and the required Emergency Response Commission are
similar, compatible, and overlapping; and
WHEREAS, The structure and composition of the Emergency
Management Advisory Council makes it the appropriate body to
designate as the Emergency Response Commission to fulfill
the requirements of the Superfund Amendments and
Reauthorization Act of 1986.
NOW, THEREFORE, I, WILLIAM DONALD SCHAEFER, GOVERNOR OF THE STATE
OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN ME BY THE
CONSTITUTION AND LAWS OF MARYLAND, AND BY PUBLIC LAW 99-499,
HEREBY PROMULGATE THE FOLLOWING EXECUTIVE ORDER
01.01.1987.11, EFFECTIVE IMMEDIATELY:
A. The Maryland Emergency Management Advisory
Council, established under Section 5 of Article 16A of
the Annotated Code of Maryland, is hereby designated
to serve as the Maryland Emergency Response Commission
under Title III of the Superfund Amendments and
Reauthorization Act of 1986 (Public Law 99-499).
B. The Maryland Emergency Response Commission shall
have all duties and responsibilities, and powers and
authorities, as mandated by Title III of the Superfund
Amendments and Reauthorization Act of 1986.
