WILLIAM DONALD SCHAEFER, Governor

(I) THE VOLUNTEER FIRE COMPANY PURCHASING THE
REQUIRED INSURANCE;

(II) THE COUNTY IN WHICH THE VOLUNTEER FIRE
COMPANY IS LOCATED PURCHASING THE REQUIRED INSURANCE FOR THE
VOLUNTEER FIRE COMPANY; OR

(III) THE COUNTY IN WHICH THE VOLUNTEER FIRE
COMPANY IS LOCATED ALLOWING THE VOLUNTEER FIRE COMPANY TO
PARTICIPATE IN THE COUNTY'S SELF INSURANCE PROGRAM THE COUNTY IN
WHICH THE AMUSEMENT RIDE OR AMUSEMENT ATTRACTION IS LOCATED MAY
PURCHASE THE REQUIRED INSURANCE FOR THE AMUSEMENT RIDE OR

ATTRACTION., ON BEHALF OF NONPROFIT ORGANIZATIONS, THE AMOUNT OF
INSURANCE REQUIRED UNDER THIS SUBTITLE FOR THE AMUSEMENT RIDE OR
AMUSEMENT ATTRACTION. A COUNTY THAT MERELY PURCHASES INSURANCE
FOR A LESSEE OR OWNER OF AN AMUSEMENT RIDE OR AMUSEMENT
ATTRACTION IS IMMUNE FROM LIABILITY FOR PERSONAL INJURY TO
INDIVIDUALS ARISING OUT OF THE USE OF THE AMUSEMENT RIDE OR
ATTRACTION.

[(b)] (C) The insurance policy shall be procured from any
insurer or surety that is acceptable to the Insurance
Commissioner of Maryland.

[(c)] (D) A certificate of insurance shall be furnished to
the Commissioner prior to the issuance of a certificate of
inspection.

(E) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2) "MECHANICAL AMUSEMENT RIDE" MEANS ANY MECHANICAL
DEVICE THAT CARRIES OR CONVEYS PASSENGERS ALONG, AROUND, OR OVER
A FIXED OR RESTRICTED ROUTE OR COURSE OR WITHIN A DEFINED AREA,
FOR THE PURPOSE OF GIVING ITS PASSENGERS AMUSEMENT, PLEASURE,
THRILLS, OR EXCITEMENT.

(3) "NONMECHANICAL AMUSEMENT RIDE" MEANS ANY DEVICE
THAT CARRIES OR CONVEYS PASSENGERS BY THE PASSENGERS' OWN POWER
OR BY GRAVITY, INCLUDING BUT NOT LIMITED TO WATER SLIDES AND
WATER FLUMES, ALONG, AROUND, OR OVER A FIXED OR RESTRICTED ROUTE
OR COURSE OR WITHIN A DEFINED AREA, FOR THE PURPOSE OF GIVING ITS
PASSENGERS AMUSEMENT, PLEASURE, THRILLS, OR EXCITEMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 65(o)
and (p), respectively, of Article 89 - Division of Labor and
Industry of the Annotated Code of Maryland be renumbered to be
Section(s) 65(n) and (o), respectively.
