Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed House Bill 43.

This bill restricts the type of jury instructions that may
be given in criminal prosecutions for rape, attempted rape,
assault with intent to commit a rape, assault with intent to
commit a sexual offense, or other sexual offenses.

Senate Bill 199, which was passed by the General Assembly
and signed by me on June 2, 1987, accomplishes the same purpose.
Therefore, it is not necessary for me to sign House Bill 43.
