WILLIAM DONALD SCHAEFER, Governor

until certain conditions are met; requiring the Maryland
Health Resources Planning Commission to develop, by a
certain date, a certain methodology and to report to the
General Assembly on the status of incorporating the
methodology into the State Health Plan requiring the State
Alcoholism Control Administration, the State Drug Abuse
Administration, and the State Health Resources Planning
Commission to report, by a certain date, to certain
committees of the General Assembly on a plan for the
implementation of, and administrative procedures for this
Act; specifying that certain facilities in existence by a
certain date may not be required to obtain a certificate of
need; providing for a delayed effective date; and generally
relating to addiction treatment facilities.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

8-411.

(a)  In this section, ["alcohol abuse facility"] "ADDICTION
ALCOHOL ABUSE AND DRUG ABUSE TREATMENT FACILITY":

(1)  Means any facility that provides treatment, care,
and rehabilitation for individuals who show the effects of DRUG
ABUSE, alcohol abuse, or alcoholism; and

(2)  Includes a facility that is owned or operated by
this State or any of its political subdivisions.

(b)  This section does not apply to:

(1)  The office of a physician who is treating
patients within the scope of the physician's practice;

(2)  Alcoholics Anonymous, NARCOTICS ANONYMOUS,
transitional housing programs, or other similar organizations,
if the organization holds meetings or provides support services
to help individuals who show the effects of DRUG ABUSE, alcohol
abuse, or alcoholism;

(3)  An employees' assistance program of a business
entity; or
