WILLIAM DONALD SCHAEFER, Governor

hundred dollars; and if a natural person shall be imprisoned, not
less than ten nor more than thirty days in the discretion of the
court; and in the case of any conviction or convictions under
this section subsequent to the second, such person or persons,
body politic or corporate shall be fined on each occasion a sum
of at least double that imposed upon him, her, them or it on the
last preceding conviction; and if a natural person, shall be
imprisoned not less than thirty nor more than sixty days in the
discretion of the court; all fines to be imposed under this
section shall be paid to the State. Notwithstanding anything to
the contrary the provisions of this section shall not apply:

(1)  To Anne Arundel County, Baltimore City, Baltimore
County, CARROLL COUNTY, Harford County, Howard County, Prince
George's County, Washington County, Worcester County, Montgomery
County, [or] Dorchester County, Charles County, or Talbot County;
or

(2)  To any person who conscientiously believes that
the seventh day of the week ought to be observed as the Sabbath
and who actually refrains from secular business and labor on that
day, and whose business establishment or establishments or
employer's business establishment or establishments (whether a
sole proprietorship, partnership or corporation) are actually
closed on that day; or

(3)  To any person who conscientiously believes that
the Sabbath begins at sundown on Friday night and ends at sundown
on Saturday night and who actually refrains from secular business
and labor during such period, and whose business establishment or
establishments or employer's business establishment or
establishments (whether a sole proprietorship, partnership or
corporation) are actually closed during such period.

(a)  The provisions of this section apply to Baltimore
County and Baltimore City.

(b)  (1) It is unlawful on Sunday for any wholesale or
retail establishment to conduct business for labor or profit in
the usual manner and location or to operate its establishment in
any manner for the general public.

(2) A wholesale or retail establishment may not
cause, direct, or authorize any employee or agent to engage in or
conduct business on its behalf on Sunday.

(c)  (1) The State's Attorney of Baltimore County may
petition the circuit court to enjoin any violation of this
section.
