AN ACT concerning
Charitable Organizations - Volunteer Immunity from Liability
FOR the purpose of prohibiting the imposition of personal
liability for damages on certain volunteers of charitable
organizations; defining certain terms; providing conditions
under which personal liability for damages will and will not
be imposed on volunteers of charitable organizations;
providing for a certain exception; and generally relating to
civil liability for damages of volunteers of certain
charitable organizations.

SECTION 1. BE IT - ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(2) "CHARITABLE ORGANIZATION" MEANS AN ORGANIZATION,
INSTITUTION, ASSOCIATION, SOCIETY, OR CORPORATION THAT IS EXEMPT
FROM TAXATION UNDER § 501(C)(3) OF THE INTERNAL REVENUE CODE OF
1954.
(3) "COMPENSATION" DOES NOT INCLUDE ACTUAL AND
NECESSARY EXPENSES THAT ARE INCURRED BY A VOLUNTEER IN CONNECTION
WITH THE SERVICES THAT HE PERFORMS FOR A CHARITABLE ORGANIZATION,
AND THAT ARE REIMBURSED TO THE VOLUNTEER OR OTHERWISE PAID.
(4) "CORPORATE SERVICES" MEANS SERVICES THAT ARE
PERFORMED BY A VOLUNTEER WHO IS ASSOCIATED WITH A CHARITABLE
ORGANIZATION AND THAT REFLECT DUTIES OR RESPONSIBILITIES ARISING
UNDER § 501(C)(3) OF THE INTERNAL REVENUE CODE OF 1954.
(5) "SUPERVISORY SERVICES" MEANS SERVICES THAT ARE
PERFORMED BY A VOLUNTEER WHO IS ASSOCIATED WITH A CHARITABLE
ORGANIZATION AND THAT INVOLVE DUTIES AND RESPONSIBILITIES IN
