(j) A conviction under this section does not relieve any
person of the necessity of securing and paying for a permit and
complying with all other applicable provisions of this section.]
3-207.
(a) (1) [The WSSC] PRINCE GEORGE'S COUNTY, MONTGOMERY
COUNTY, THE CITY OF BOWIE, and any person or any municipality may
not adopt a [drainage] STORMWATER MANAGEMENT plan, system, or
design, including a capital improvement program for stormwater
management:
(i) Unless the [drainage] STORMWATER MANAGEMENT
plan or design is in accordance with the 6-year [Capital
Improvements Program] CAPITAL IMPROVEMENT PROGRAM of the [WSSC
under Title 7 of this article] JURISDICTION RESPONSIBLE FOR
STORMWATER MANAGEMENT IN THE AFFECTED AREA and is approved by
[the WSSC] THAT JURISDICTION; AND
(ii) [Except as provided in paragraph (2) of
this subsection; and
(iii)] Except for the protection of an
individual's home WHERE IT HAS NO ADVERSE IMPACT ON OTHER
PROPERTIES OR STORMWATER MANAGEMENT SYSTEMS.
(2) (i) [In the City of Bowie or in Montgomery
County, except for that portion of the City of Takoma Park
located in Montgomery County, the approval required by paragraph
(1) of this subsection shall be given respectively by the City of
Bowie or by Montgomery County and not the WSSC.
(ii)] If PRINCE GEORGE'S COUNTY, the City of
Bowie, or Montgomery County prepares a [drainage] STORMWATER
MANAGEMENT plan, system, or design, or if a [drainage] STORMWATER
MANAGEMENT plan, system, or design has been submitted to the City
of Bowie, [or] Montgomery County, OR PRINCE GEORGE'S COUNTY, the
City or [Montgomery County] THE COUNTY shall submit a copy of the
plan, system, or design to the WSSC, which shall have a
specified, reasonable time to review and comment on the plan,
system, or design to the City [of Bowie or Montgomery County] OR
THE COUNTY to indicate any conflicts in the plan, system, or
design with the existing or planned water supply or sanitary
sewer systems of the WSSC. The approval by PRINCE GEORGE'S
COUNTY, Montgomery County, or the City of Bowie shall avoid any
of the conflicts identified by the WSSC.
[(iii)] (II) When the WSSC receives a copy of a
plan from the City of Bowie, the WSSC shall promptly provide a
copy to the County Council and County Executive of Prince
George's County for review and comment.
