3-201.

(A)  (1) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)  "BONDS" MEANS BONDS, NOTES, AND OTHER
OBLIGATIONS.

(3)   "STORMWATER MANAGEMENT" MEANS AND INCLUDES THE
PLANNING, DESIGNING, ACQUISITION, CONSTRUCTION, DEMOLITION,
MAINTENANCE, AND OPERATION OF FACILITIES, PRACTICES, AND PROGRAMS
FOR THE CONTROL AND DISPOSITION OF STORM AND SURFACE WATERS,
INCLUDING FLOODPROOFING AND FLOOD CONTROL AND NAVIGATION
PROGRAMS.

(4)  "STORMWATER MANAGEMENT DISTRICT" OR "DISTRICT"
MEANS THE STORMWATER MANAGEMENT DISTRICT AUTHORIZED TO BE
ESTABLISHED UNDER THIS SUBTITLE.

(B)  THE POWERS UNDER THIS SUBTITLE ARE IN ADDITION TO THOSE
CONFERRED BY ANY OTHER LAW. THIS SUBTITLE SHALL BE LIBERALLY
CONSTRUED TO CARRY OUT ITS PURPOSES.

[3-202.

(a)  In the sanitary district and in accordance with the
WSSC's Capital Improvements Program, the WSSC may plan, design,
construct, maintain, and operate a system for the control and
disposition of surface waters.

(b)  The WSSC may implement the WSSC's Capital Improvements
Program, including the right to condemn under § 1-202 of this
article, and may negotiate and make contracts with any public
agency, including the government or any bureau or department of
the United States.]

3-202.                                                                               

(A) ON AND AFTER JULY 1, 1987, EACH COUNTY SHALL EXERCISE
WITHIN ITS BOUNDARIES ALL THE RIGHTS, POWERS, AND DUTIES RELATING
TO STORMWATER MANAGEMENT, INCLUDING THOSE FORMERLY EXERCISED BY
THE WSSC, EXCEPT THAT PRINCE GEORGE'S COUNTY MAY NOT EXERCISE
THIS AUTHORITY WITHIN THE CITY OF BOWIE UNLESS THE CITY AND THE
COUNTY OTHERWISE AGREE.

(B) (1) EACH PRINCE GEORGE'S COUNTY MAY ESTABLISH A
STORMWATER MANAGEMENT DISTRICT, WHICH MAY INCLUDE ALL THE LAND
WITHIN THE BOUNDARIES OF PRINCE GEORGE'S COUNTY, EXCEPT FOR THE
LAND WITHIN THE CITY OF BOWIE AS ITS BOUNDARIES EXISTED ON JULY
1, 1987.
