A person may not operate a hospice CARE PROGRAM unless
licensed by the Secretary.

A hospice FACILITY may not admit an individual unless a
physician estimates that the individual has a life expectancy of
less than 6 months NO REASONABLE PROSPECT OF CURE.
SECTION 2. AND BE IT FURTHER ENACTED, That those hospice
care programs in existence and delivering hospice care services
before January 1, 1987, that request licensure between July 1,
1987 and July 1, 1988, shall not be required to obtain a
certificate of need prior to licensure. However, those hospice
care programs seeking exemption from formal submission of a
certificate of need for a hospice care program under this section
shall meet the criteria established by the Maryland Health
Resources Planning Commission in consultation with interested
groups, including the Hospice Network of Maryland, Inc. for
determining whether a hospice care program was in existence and
delivering hospice care services before January 1, 1987.
SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1987.

(House Bill 533)
AN ACT concerning
Maryland Coal Tax
FOR the purpose of altering the amount of tax imposed on each ton
of surface mined coal; altering the date on which the
Maryland Coal Tax expires; repealing a requirement that
counties expend certain moneys derived from the tax for
reconstruction, repair, or maintenance of county coal haul
roads and bridges; repealing a requirement that governing
bodies make certain distributions of a certain portion of
moneys derived from the tax; and permitting governing bodies
to make certain distributions of up to a certain portion of
the moneys derived from the tax; and generally relating to
the Coal Tax.
BY repealing and reenacting, with amendments,
