Occupations Article has been held by a court to be void for
vagueness vague; and
WHEREAS, Section 14-306(b)(5) of the Health Occupations
Article currently refers to "1 academic year of supervised
clinical training" as being required for applicants who study
medicine at a recognized foreign medical school, and it is
unclear whether this refers to postgraduate education only; and
WHEREAS, The State Board of Medical Examiners finds it
impossible to evaluate the credentials of some medical schools
outside of the United States, its possessions or territories,
Puerto Rico, or Canada; and
WHEREAS, To clarify these situations and others that arise
in evaluating the credentials of graduates of foreign medical
schools, the provisions of this Act provide the State Board of
Medical Examiners with acceptable evaluation guidelines; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 14-101(f) through (l), respectively, of
Article - Health Occupations of the Annotated Code of Maryland be
renumbered to be Section(s) 14-101(h) through (n), respectively.
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:
Article - Health Occupations
14-101.
(a) In this title the following words have the meanings
indicated.
(F) "FOREIGN MEDICAL SCHOOL" MEANS A MEDICAL SCHOOL THAT IS
LOCATED OUTSIDE OF THE UNITED STATES, ITS TERRITORIES OR
POSSESSION, PUERTO RICO, OR CANADA.
(G) "GRADUATE" MEANS AN INDIVIDUAL WHO:
(1) HAS MET ALL OF THE GRADUATION REQUIREMENTS OF A
FOREIGN MEDICAL SCHOOL; AND
(2) HAS RECEIVED A MEDICAL DEGREE OR DIPLOMA FROM THE
SCHOOL.

(a) To qualify for a license, an applicant shall be an
individual who meets the requirements of this section.
