WILLIAM DONALD SCHAEFER, Governor                    Ch. 660

OPTION OF THE COMPTROLLER, PAY TO THE PERSON AN AMOUNT EQUAL TO
THE VALUE OF THE PETROLEUM PRODUCTS AS DETERMINED BY THE AVERAGE
WHOLESALE VALUE ON THE DATE OF SEIZURE FOR THE BALTIMORE TERMINAL
AS REPORTED BY PLATT'S OIL-GRAM; AND

(2) THE CONVEYANCE IS NOT SUBJECT TO FORFEITURE, THE
COMPTROLLER SHALL RETURN THE CONVEYANCE TO THE REGISTERED OWNER
AND SHALL HAVE NO FURTHER LIABILITY TO THE REGISTERED OWNER.

(H) (1) WITH RESPECT TO ANY PETROLEUM PRODUCTS OR
CONVEYANCE FORFEITED HEREUNDER, THE COMPTROLLER MAY SHALL:

(I)  USE THE PROPERTY CONTRABAND PETROLEUM
PRODUCT FOR ANY PUBLIC PURPOSE; OR

(II)  SELL THE PROPERTY SEIZED CONVEYANCE OR
CONTRABAND PETROLEUM PRODUCT TO ANY PERSON.

(2) IN THE EVENT OF A SALE OF THE PROPERTY, THE
COMPTROLLER SHALL DISTRIBUTE THE NET PROCEEDS FROM THE SALE,
UNDER § 137 OF THIS ARTICLE AFTER PAYING:

(I)  ALL COSTS INCURRED IN CONJUNCTION WITH THE
SEIZURE AND DISPOSAL OF THE PROPERTY;

(II)  THE COST OF THE SALE; AND

(III)  ANY BONA FIDE LIEN AGAINST ANY CONVEYANCE
SOLD.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
