AN ACT concerning

Licenses - Motor Vehicle Fuel Tax - Contraband Petroleum Products

FOR the purpose of providing for the seizure of contraband
petroleum products and conveyances under certain
circumstances; providing for the furnishing of notice of
the seizure to certain persons; authorizing the Comptroller
to release certain property under certain circumstances;
authorizing a person certain interested persons to file a
claim for the return of seized property; providing for an
opportunity for a hearing; providing certain remedies when
forfeiture is determined to be inappropriate; providing for
the disposition of certain seized property; and generally
relating to the seizure and forfeiture of contraband
petroleum products and conveyances.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 56 - Licenses

138.

(A) IN THIS SECTION, THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(1)  "CONTRABAND PETROLEUM PRODUCTS" MEANS MOTOR
VEHICLE FUEL AND AVIATION FUEL:

(I)  ON WHICH THE MARYLAND MOTOR VEHICLE FUEL
TAX OR AVIATION FUEL TAX IS NOT PAID; AND

(II)  THAT IS DELIVERED, POSSESSED, SOLD OR
TRANSFERRED IN THE STATE IN A MANNER NOT AUTHORIZED UNDER THIS
ARTICLE.

(2)  "CONVEYANCE" MEANS ANY CARRYING OR TRANSPORTING
DEVICE WHICH HAS A CAPACITY EXCEEDING 50 GALLONS, EXCLUSIVE OF

ANY FUEL SUPPLY TANK, USED FOR ITS OWN PROPULSION. THE TERM
INCLUDES A VEHICLE, VESSEL, OR TANK CAR".
