circumstances of a particular type of procurement or a particular
State agency do not require otherwise, are substantially the
same.

(2)  The Board may delegate any of its authority and
may require prior Board approval for specified procurement
actions.

(3)  Except as limited by the State Constitution, the
Board may exercise any control authority conferred on a
department by this Division II, and to the extent that its action
conflicts with the action of the Department, the action of the
Board shall prevail.

(e) (1) Under the coordination of the Governor, the

departments, subject to the approval of the Board, shall adopt

regulations to implement all of the provisions of this Division
II.

11-110.

(b) (2) (iii) If bid prices are reasonably expected to
exceed $25,000, or a lower threshold amount set by the Board by
regulation, IN ACCORDANCE WITH TITLE 10, SUBTITLE 1 OF THE STATE
GOVERNMENT ARTICLE, notice of the invitation for bids shall be
published in the Maryland Register at least 20 days before bid
opening. This subparagraph does not apply to a procurement if
the resulting contract is reasonably expected to be performed
entirely outside this State and the District of Columbia.

11-128.

The Board shall, by regulation, IN ACCORDANCE WITH TITLE 10,
SUBTITLE 1 OF THE STATE GOVERNMENT ARTICLE, adopt price and cost
principles, based on generally accepted accounting principles,
which shall be used:

(1)  as guidelines in negotiating:

(i) estimated costs or fixed prices;

(ii) price adjustments for contract
modifications and change orders; and

(iii) settlements of terminated contracts;

(2)  to establish the allowability of costs under
contract provisions for the reimbursement of costs; and

(3)  in any other situation that requires the
establishment of the estimated or incurred costs of performing a
contract.
