the person, including the sex, race, approximate height, weight,
and age, and any distinguishing features; or

(iii) A statement that the person making the

transaction is personally known to the    dealer and that the

information required by this paragraph is on file with the
dealer.

(A)   [The] SUBJECT TO SUBSECTION (B) OF THIS SECTION, THE
denial, nonrenewal, suspension, or revocation of a license shall
be preceded by notice and an opportunity to be heard as provided
in the Administrative Procedure Act, and an applicant or licensee
is entitled to judicial review as provided in that Act.

(B)  (1) THE SECRETARY MAY SEEK AN IMMEDIATE RESTRAINING
ORDER FROM A CIRCUIT COURT OF COMPETENT JURISDICTION TO PROHIBIT
A DEALER FROM BUYING OR SELLING SECONDHAND PRECIOUS METALS,
DISPOSING OF SECONDHAND PRECIOUS METALS, OR DISPOSING OF RECORDS
CONCERNING SECONDHAND PRECIOUS METALS IF THE DEALER HAS BEEN
CHARGED WITH A VIOLATION OF THIS SUBTITLE THAT COULD RESULT IN
SUSPENSION OR REVOCATION OF THE DEALER'S LICENSE.

(2) A RESTRAINING ORDER ISSUED BY A COURT UNDER THIS
SUBSECTION IS EFFECTIVE UNTIL:

(I)  THE COURT LIFTS THE RESTRAINING ORDER; OR

(II)  THE CHARGES ARE DISMISSED OR ADJUDICATED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
