once entry has been gained. This is implicit in the
source law reference that entry shall be allowed for
the purpose of collecting samples, records, and
information.
In subsection (c) of this section, the references to
"land" are substituted for the former references to
"premises", for clarity and to conform to the apparent
intent of the law.
9-262. REVOCATION OF, CHANGES TO, AND EXPIRATION OF PERMITS
ISSUED BY SECRETARY.
(A) SCOPE OF SECTION.
THIS SECTION DOES NOT APPLY TO THE EXPIRATION, REVOCATION,
OR MODIFICATION OF A SEWAGE SLUDGE UTILIZATION PERMIT.
(B) REVOCATION; CHANGE.
IN ACCORDANCE WITH THE ADMINISTRATIVE PROCEDURE ACT, THE
SECRETARY MAY REVOKE OR CHANGE ANY PERMIT ISSUED UNDER THIS
SUBTITLE AFTER THE SECRETARY NOTIFIES GIVES THE PERMIT HOLDER
NOTICE OF THE PROPOSED REVOCATION OR CHANGE.
(C) EXPIRATION.
IF THE TERM OF A PERMIT ISSUED UNDER THIS SUBTITLE IS STATED
IN THE PERMIT, THE PERMIT EXPIRES AT THE END OF THE STATED TERM.
REVISOR'S NOTE: Subsection (a) of this section is new
language added to clarify that this section does not
apply to the expiration, revocation, or modification
of a, sewage sludge utilization permit. In this
regard, see §§ 9-238 and 9-246 of this subtitle.
Subsections (b) and (c) of this section are new
language derived without substantive change from
former HE § 9-223.
9-263. JUDICIAL REVIEW.
(A) NOTICE AND OPPORTUNITY FOR A HEARING.
IN ACCORDANCE WITH THE ADMINISTRATIVE PROCEDURE ACT, BEFORE
IMPOSING A FINAL ORDER UNDER THIS SUBTITLE, THE DEPARTMENT SHALL:
(1) NOTIFY THE PERSON TO WHOM THE ORDER IS DIRECTED;
AND
(2) PROVIDE THE PERSON WITH AN OPPORTUNITY FOR A
HEARING.
