(II) THE QUALITY OF THE WATER HAS BEEN INJURED
BY HANDLING OF THE WATER AFTER IT HAS ARRIVED IN THIS STATE.

(E)  SAME — PROHIBITED WITHOUT PERMIT.

A PERSON MAY NOT SELL DRINKING WATER FROM OUTSIDE THIS STATE
UNLESS THE PERSON HAS A PERMIT UNDER SUBSECTION (D)(1) OF THIS
SECTION.

(F)  DATING CONTAINERS.

A PERSON MAY NOT PACKAGE OR SELL IN THIS STATE DRINKING
WATER IN INDIVIDUAL CONTAINERS MADE OF PAPER OR PLASTIC-COATED
PAPER UNLESS EACH CONTAINER IS MARKED WITH A STENCIL OR STAMP
THAT CLEARLY STATES THE MONTH AND DAY WHEN THE WATER WAS PLACED
IN THE CONTAINER.

REVISOR'S NOTE: Subsections (a), (b), (c), (d)(2) and (3),
(e), and (f) of this section are new language derived
without substantive change from former HE § 9-220.

In subsections (b) through (e) of this section, the
references to collecting, bottling, and delivering
water "in containers" are new language added to
conform to the apparent intent of the General Assembly
in adding those references to subsections (a) and (f)
of this section.

Subsection (d)(1) of this section is standard language
added to state clearly that a person who sells
drinking water shipped from outside the State must
have a permit from the Department.

In the introductory language to subsection (a) of this

section, the word "jurisdiction" is substituted for

the former words "supervision and control", for
clarity and conciseness.

In subsection (a)(1) of this section, the former
reference to a source of water being "either surface
or underground" is deleted as unnecessary in light of
the clause "any source from which drinking water is
collected".

The General Assembly may wish to consider whether
subsection (f) of this section should be expanded to
require that all containers, instead of only paper
containers and plastic-coated paper containers, be
dated. This addition would include containers made of
plastic, glass, and other nonpaper materials.
