WILLIAM DONALD SCHAEFER, Governor                   Ch. 612

(A)  TERM OF PERMIT.

A SEWAGE SLUDGE UTILIZATION PERMIT EXPIRES ON THE DATE THE
DEPARTMENT SETS AT THE TIME OF ISSUANCE OR RENEWAL, UNLESS THE
PERMIT IS RENEWED FOR ANOTHER TERM AS PROVIDED IN THIS SECTION.

(B)  RENEWAL OF PERMIT.

THE DEPARTMENT MAY RENEW A SEWAGE SLUDGE UTILIZATION PERMIT
IF THE PERMIT HOLDER:

(1)  IS IN COMPLIANCE WITH THE PERMIT AND ALL
APPROPRIATE REGULATIONS OF THE DEPARTMENT;

(2)  SUBMITS TO THE DEPARTMENT A RENEWAL APPLICATION
ON THE FORM THAT THE DEPARTMENT REQUIRES; AND

(3)  PAYS THE RENEWAL APPLICATION FEE THAT THE
DEPARTMENT REQUIRES.

REVISOR'S NOTE: This section formerly appeared as HE §
9-210.1(e)(5).

In subsection (b)(1) of this section, the reference to
"[i]s in compliance with the permit" is new language
added to conform to the provisions of § 9-246(a)(4)
and (b)(1) of this subtitle, under which the
Department may revoke a sewage sludge utilization
permit if the permit holder does not conform to the
conditions of the permit.

The only other changes are in style.

As to the power of the Department to refuse to renew a
sewage sludge utilization permit, see § 9-246(b) of
this subtitle.

9-239. SAME — CERTAIN PERMITS TO REMAIN EFFECTIVE.

A SEWAGE SLUDGE UTILIZATION PERMIT IN EFFECT ON JULY 1, 1984
REMAINS IN EFFECT UNTIL THE EXPIRATION DATE OF THE PERMIT.

9-240. MAINTAINING BOND OR OTHER SECURITY; COMPLYING WITH
REQUIREMENTS.
