Ch. 612

LAWS OF MARYLAND

(3) (I) "INFECTIOUS WASTE" MEANS ANY WASTE THAT COMES,
FROM A HOSPITAL, CLINIC, OR LABORATORY AND, THAT IS KNOWN OR
SUSPECTED TO BE CONTAMINATED WITH ORGANISMS, CAPABLE OF PRODUCING
DISEASE OR INFECTION IN HUMANS.

(II) "INFECTIOUS WASTE" INCLUDES:

1.  DISPOSABLE EQUIPMENT, INSTRUMENTS,, AND
UTENSILS;

2.  CONTAMINATED NEEDLES, SCALPELS, AND
RAZOR BLADES;                                                                           

3.  HUMAN TISSUES AND ORGANS THAT RESULT
FROM SURGERY, OBSTETRICS, OR AUTOPSY;

4.  FECES, URINE, VOMITUS, AND
SUCTIONINGS;

5.  LIVE VACCINES FOR HUMAN USE;

6.  BLOOD AND BLOOD PRODUCTS; AND

7.  LABORATORY SPECIMENS, SUCH AS TISSUES,
BLOOD ELEMENTS, EXCRETA, AND SECRETIONS.

(B) SCOPE OF SECTION.

THIS SECTION DOES NOT PREVENT A PERSON FROM DISPOSING OF
INFECTIOUS WASTE, OR CAUSING INFECTIOUS WASTE TO BE DISPOSED OF,
IN AN INCINERATOR.

(C) (B) DISPOSAL OF INFECTIOUS WASTE IN LANDFILL SYSTEM.

A HOSPITAL, CLINIC, OR LABORATORY MAY NOT DISPOSE OF
INFECTIOUS WASTE, OR CAUSE INFECTIOUS WASTE TO BE DISPOSED OF, IN
A LANDFILL SYSTEM IN THIS STATE.

(D) (C) SECRETARY TO ASSIST IN MONITORING AND ENFORCEMENT
OF SECTION.

THE SECRETARY IS RESPONSIBLE WITH LAW ENFORCEMENT PERSONNEL
IN THIS STATE FOR MONITORING AND ENFORCING SUBSECTION (C) (B) OF
THIS SECTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former HE § 9-210(g).

The General Assembly may wish to consider amending the
definition of "infectious waste" in subsection (a)(3)
of this section to take into account other relevant
factors. For example, the United States Environmental
Protection Agency has a lengthy definition of
