(C)  CHANGING METHODS OF WASTE DISPOSAL -- PERMIT REQUIRED.

A PERSON WHO IS SUBJECT TO AN ORDER ISSUED UNDER THIS
SECTION SHALL HAVE A PERMIT ISSUED BY THE SECRETARY UNDER THIS
SECTION BEFORE THE' PERSON MAY CHANGE THE WASTE DISPOSAL METHODS
USED BY AN INDUSTRIAL ESTABLISHMENT.

(D)  SAME — SUBMISSION OF PLANS TO SECRETARY; CONSTRUCTION
TO CONFORM WITH PLANS.

THE OWNER OR OPERATOR OF AN INDUSTRIAL ESTABLISHMENT SHALL:

(1) A PERSON WHO IS SUBJECT TO AN ORDER ISSUED UNDER
THIS SECTION SHALL SUBMIT TO THE SECRETARY FOR APPROVAL ANY PLANS
TO CHANGE THE WASTE DISPOSAL METHODS USED BY THE INDUSTRIAL
ESTABLISHMENT; AND.

(2) CARRY OUT ANY CONSTRUCTION IN ACCORDANCE WITH THE
APPROVED PLANS.

(E)  SAME — ISSUANCE OF PERMIT.

IF THE SECRETARY APPROVES PLANS UNDER SUBSECTION (D)(1) OF
THIS SECTION, THE SECRETARY SHALL ISSUE A PERMIT TO THE OWNER OR
OPERATOR.

(F)  SAME — PROHIBITED WITHOUT PERMIT.

A PERSON WHO IS SUBJECT TO AN ORDER ISSUED UNDER THIS
SECTION:

(1) SHALL CARRY OUT ANY CONSTRUCTION IN ACCORDANCE
WITH THE APPROVED PLANS; AND

(2)  MAY NOT CHANGE THE METHODS OF DISPOSING OF WASTE
AT AN INDUSTRIAL ESTABLISHMENT IN THIS STATE EXCEPT IN ACCORDANCE
WITH A PERMIT ISSUED TO THE PERSON BY THE SECRETARY UNDER THIS
SECTION.

REVISOR'S NOTE: Subsections (a), (b), (d), (e), and (f) of
this section are new language derived without
substantive change from former HE § 9-217.

Subsection (c) of this section is standard language
added to state expressly that a person is required to
have a permit before the person who is subject to an
order issued under this section may change the methods
of waste disposal at an industrial establishment.

Throughout this section, the references to "operator"
of an industrial establishment are added to conform to
the practice of the Department in administering this
section.
