WILLIAM DONALD SCHAEFER, Governor                   Ch. 612

THE DEPARTMENT AND ANY LOCAL GOVERNMENT MAY MAKE A JOINT
FINANCING AGREEMENT TO USE ANY AVAILABLE FEDERAL GRANT FOR THE
PREPARATION, AMENDMENT, OR REVISION OF A COUNTY PLAN PLANNING
UNDER THIS SECTION.

(F)  USE OF GENERAL FUNDS OF COUNTY OR MUNICIPAL
CORPORATION.

ANY COUNTY OR MUNICIPAL CORPORATION MAY APPROPRIATE ITS
GENERAL FUNDS TO PARTICIPATE IN THE PREPARATION, AMENDMENT, OR
REVISION OF A COUNTY PLAN PLANNING UNDER THIS SECTION.

(G)  USE OF GENERAL FUNDS BY SPECIAL GOVERNMENT AGENCY.

IF A SPECIAL GOVERNMENT AGENCY IS CHARGED WITH PROVIDING
SANITARY FACILITIES IN A COUNTY OR MUNICIPAL CORPORATION, THE
DEPARTMENT, THE COUNTY, OR THE MUNICIPAL CORPORATION MAY MAKE
GENERAL FUNDS AVAILABLE TO THAT AGENCY FOR THE PREPARATION,
AMENDMENT, OR REVISION OF A COUNTY PLAN PLANNING UNDER THIS
SECTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former HE § 9-203.

In subsections (f) and (g) of this section, the
references to "municipal corporation" are substituted
for the former words "municipalities" and
"municipality" to conform to the language used in Md.
Constitution, Art. XI-E.

The General Assembly may wish to consider deleting
subsections (a) and (b) of this section, since the
Department advises that they are unnecessary and that
there are no funds remaining in the Sanitary
Facilities Fund. The Department depends on this
section only to authorize the use of funds
appropriated in the general operating budget of the
State to pay for the preparation, amendment, or
revision of the county water and sewerage plans
required by § 9-503 of this title. In this regard,
the Department gives funds to the counties under the
Case formula.

The General Assembly may wish to consider clarifying
the reference to "sanitary facilities" in subsection
(g) of this section. Specifically, does the General
Assembly wish "sanitary facilities" to refer only to
water and sewerage services?

9-219. APPROPRIATION OF FEDERAL OR OTHER FUNDS FOR SEWERAGE
SYSTEMS, COLLECTOR LINES, OR FACILITIES IN PATUXENT RIVER
WATERSHED.
