LAWS OF. MARYLAND

Former HE § 9-210(e)(l) and (2), as those paragraphs
applied to the term of permits for sludge composting
facilities, are deleted as unnecessary in light of the
more comprehensive provisions of § 9-238 of this
subtitle.

9-214. SAME — REFUSING TO RENEW PERMIT.

THE DEPARTMENT MAY REVOKE OR REFUSE TO RENEW A PERMIT FOR A
REFUSE DISPOSAL LANDFILL SYSTEM IF:

(1)  THE PERMIT HOLDER VIOLATES ANY PROVISION OF THIS
SUBTITLE, ANY REGULATION ADOPTED UNDER THIS SUBTITLE, OR ANY
CONDITION OF THE PERMIT;

(2)  THE DEPARTMENT FINDS THAT CONTINUED OPERATION OF
THE REFUSE DISPOSAL SYSTEM COULD HARM WOULD BE INJURIOUS TO
PUBLIC HEALTH OR THE ENVIRONMENT; OR

(3)  THE DEPARTMENT FINDS THAT THERE IS ANY OTHER GOOD
CAUSE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former HE §
9-210(e)(3), as that subsection related to permits for
landfill systems.

In the introductory language of this section, the term
"landfill system" is substituted for the former
reference to "landfill refuse disposal system" to
avoid incorporating the defined term "refuse disposal
system" into the provisions of this section.

In practice, the Department applies the Administrative
Procedure Act to refuse to renew a permit for a
landfill system.

9-215. SAME — CLOSING AND COVERING WHEN OPERATIONS END.

(A) CLOSING AND COVERING REQUIRED.

WHEN LANDFILL OPERATIONS END, THE HOLDER OF A PERMIT ISSUED
UNDER THIS SUBTITLE FOR A LANDFILL SYSTEM SHALL CLOSE. AND COVER
ALL OF THE LAND FOR WHICH THE PERMIT WAS ISSUED IN A MANNER THAT
PREVENTS:

(1)  EROSION;

(2)  HEALTH AND SAFETY HAZARDS;

(3)  NUISANCES; AND

(4)  POLLUTION.
