WILLIAM DONALD SCHAEFER, Governor Ch. 612
(I) THE CHANNELS USED OR INTENDED TO BE USED TO
COLLECT AND DISPOSE OF SEWAGE; AND
(II) ANY STRUCTURE OR APPURTENANCE USED OR
INTENDED TO BE USED TO COLLECT OR PREPARE SEWAGE FOR DISCHARGE
INTO THE WATERS OF THIS STATE.
(2) "SEWERAGE SYSTEM" INCLUDES ANY SEWER OF ANY SIZE.
(3) "SEWERAGE SYSTEM" DOES NOT INCLUDE THE PLUMBING
SYSTEM INSIDE ANY BUILDING SERVED BY THE SEWERAGE SYSTEM.
REVISOR'S NOTE: This subsection is new language derived
without substantive change from former HE § 9-201(d).
In paragraph (1) of this subsection, the references to
"or intended to be used" are new language added to
conform to the definition of "sewerage system" in §
9-501 of this title.
In paragraph (l)(i) of this subsection, the former
reference to a sewerage system also meaning "the body
of water into which it [sewage] is directly
discharged" is deleted as confusing and out of date.
A person does not need a permit to discharge sewage
into a sewerage system, but the Department now
requires a person to have a permit to discharge sewage
into the waters of this State. Therefore, to avoid
confusion and to update the law in accordance with
modern methods of disposal, it is no longer
appropriate to define a sewerage system as meaning the
body of water into which sewage is discharged
directly.
In paragraph (l)(ii) of this subsection, the former
reference to the collection and preparation of sewage
for discharge "in satisfactory condition" is deleted
as unnecessary in light of other requirements.
For a similar definition of "sewerage system", see §
9-501 of this title.
(K) UTILIZE SEWAGE SLUDGE.
"UTILIZE SEWAGE SLUDGE" MEANS TO COLLECT, HANDLE, BURN,
STORE, TREAT, OR TRANSPORT SEWAGE SLUDGE, TO APPLY IT TO LAND, OR
TO DISPOSE OF IT.
REVISOR'S NOTE: This subsection is new language derived
without substantive change from former HE § 9-201(h).
