Ch. 605

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 56 - Licenses

254.

(a) An applicant may not be scheduled for an examination
required by this subtitle until the applicant has paid a
nonrefundable examination fee [of $10]. THE FEE SHALL BE
DETERMINED BY THE COMMISSION AND SHALL DEFRAY ONLY THE COST OF
THE EXAMINATION.

256.

No contractor's, subcontractor's or salesman's license may
be required of any person when acting in the particular capacity
or particular type of transaction set forth in this section:

(2) A plumber, electrician, architect or any other
such person who is required by State or local law to attain
standards of competency or experience as a prerequisite to

engaging in such craft or profession, and who is acting

exclusively within BOTH (I) THE JURISDICTION WHICH ISSUED THE
LICENSE, AND (II) the scope of the craft or profession for which

he is currently licensed pursuant to such other law. The

installation of central heating or air conditioning systems by
such a person shall be deemed within the scope of such person's

craft or profession. No salesman's license shall be required of

the salesman in regard to such a transaction. ANY STATE OR LOCAL
AGENCY WHICH LICENSES A PLUMBER, ELECTRICIAN, ARCHITECT OR ANY

OTHER PERSON TO INSTALL WHO INSTALLS CENTRAL HEATING OR

AIR CONDITIONING SYSTEMS MAY SANCTION THAT PERSON

ADMINISTRATIVELY FOR VIOLATIONS OF THE HOME IMPROVEMENT LAW IN
THE INSTALLATION OF CENTRAL HEARING OR AIR CONDITIONING SYSTEM.

257.

(L) IN ORDER TO OBTAIN A AN ORIGINAL A CONTRACTOR'S
LICENSE, AN APPLICANT MUST HAVE EITHER.

(1) 2 YEARS OF SATISFACTORY TRADE EXPERIENCE AS A
LICENSED SUBCONTRACTOR; OR

(2) 3 YEARS OF OTHER TRADE EXPERIENCE WITHIN THE PAST
10 YEARS WHICH THE COMMISSION DETERMINES HAS PREPARED THE

APPLICANT TO DO BUSINESS AS A CONTRACTOR. THE COMMISSION MAY

CREDIT AN APPLICANT WITH UP TO 1 YEAR FOR TECHNICAL TRAINING IN
AN ACCREDITED COLLEGE, UNIVERSITY, POSTSECONDARY PROPRIETARY
INSTITUTION, OR MANUFACTURER'S TRAINING PROGRAM.
