AN ACT concerning
Medical Injury Awards - Modification and Remittitur
FOR the purpose of providing for a modification or remittitur in
awards for medical injury under certain circumstances;
providing for the applicability of these procedures under
certain circumstances; prohibiting the exercise of certain
subrogation rights in medical injury claims; providing for
the admissibility in a judicial proceeding of an unmodified
arbitration award for a medical injury under certain
circumstances; providing for rules and regulations by the
Insurance Commissioner to govern the establishment,
maintenance and administration of security provided by
certain insurers under certain circumstances; providing for
a waiver of arbitration procedures under certain conditions;
providing for the collection and reporting of certain data
relating to certain liability insurance; requiring that the
Insurance Commissioner submit the collected data and to make
certain recommendations to the Maryland General Assembly at
a certain time; defining certain terms; creating a Tort and
Insurance Reform Oversight Committee; providing for the
membership, duties, and powers of the Oversight Committee;
providing that the Insurance Commissioner must cooperate
fully with the Oversight Committee; providing for certain
dates for initial filing of certain reports; providing for
the security of award of future damages under certain
circumstances; and generally relating to the modification,
reduction, or remittitur of damage awards in medical injury
claims under certain circumstances.
