SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 101 - Workmen's Compensation

36.

Each employee (or in the case of death his family or
dependents) entitled to receive compensation under this article
shall receive the same in accordance with the following schedule
and except as in this article otherwise provided, such payment
shall be in lieu of any and all rights of action whatsoever
against any person whomsoever.

(9) (A) IN THIS ARTICLE, THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED:

(I) "VOCATIONAL REHABILITATION" MEANS
PROFESSIONAL SERVICES REASONABLY NECESSARY TO ENABLE AN INJURED
EMPLOYEE, AS SOON AS PRACTICAL, TO ACHIEVE MAXIMUM MEDICAL
IMPROVEMENT AND SECURE SUITABLE GAINFUL EMPLOYMENT.

(II) "SUITABLE GAINFUL EMPLOYMENT" MEANS

EMPLOYMENT OR SELF EMPLOYMENT WHICH RESTORES THE INJURED EMPLOYEE
AS SOON AS PRACTICAL TO MAXIMUM SELF SUPPORT, DUE CONSIDERATION
BEING GIVEN TO THE EMPLOYEE'S QUALIFICATIONS, INTERESTS AND
INCENTIVES, PREINJURY EARNINGS, FUTURE EARNINGS CAPACITY, AND THE
CURRENT AND FUTURE LABOR MARKET.
