on Sunday for any wholesale or retail establishment to conduct
business for labor or profit in the usual manner and location or
to operate its establishment in any manner for the general
public. It may not cause, direct, permit or authorize any
employee or agent to engage in or conduct business on its behalf
on Sunday.
(b) Notwithstanding any other provision of this section,
the operation of any of the following types of retail
establishments, to sell or deliver only those items enumerated in
this section, is allowed on Sunday:
(1) Retailers who may sell and deliver tobacco
products, candy, sodas and soft drinks, ice cream, ices and other
confectionery, hosiery, newspapers, magazines, stationery items,
greeting cards, books, souvenirs, film and camera supplies,
drugs, patent medicines, toilet articles, hygienic items, baby
needs, medical supplies and related items, cosmetics and beauty
aids, and food or foodstuffs prepared or intended for human or
household pet consumption.
(2) Delicatessens whose principal business is the
sale of delicatessens and related food items.
(3) Bakeries and bakeshops.
(4) Gasoline stations whose principal business is the
sale of gasoline, oil, and other automobile maintenance items.
(5) Restaurants, grills, and snack bars.
(c) This section does not apply to:
(1) Farmers.
(2) Nurserymen.
(3) Antique dealers and flea markets.
(d) Notwithstanding any other provision of this section,
any retail establishment may conduct business in the usual manner
on the four consecutive successive Sundays that immediately
precede December 25.
(e) This section is not applicable to any person who by
reason of his religious conviction observes a day other than
Sunday as his day of rest and actually refrains from labor or
secular business on that day, and whose establishment is closed
for business on that day. The term "a day other than Sunday" as
used herein means any consecutive 24-hour period.
