AN ACT concerning

State Waterway Construction and Water Appropriation and
Use Permits - Publication of Notice for Hearings

FOR the purpose of authorizing certain persons in certain
counties to publish certain notices of hearings for State
waterway construction permits and State water appropriation
and use permits in certain newspapers.

BY repealing and reenacting, with amendments,

Preamble

WHEREAS, The expenses that are involved in providing public
notices for hearings on water appropriation and use permits and
permits to construct or repair reservoirs, dams, or waterway
obstructions are, in certain circumstances, out of proportion to
the cost of certain low-cost construction projects; and

WHEREAS, Certain counties in the State do not have a daily
newspaper in which to print the required public notices for these
permits; and

WHEREAS, The only daily newspapers that are available in

those counties that do not have a locally-published daily

newspaper may not even be read by the people in those counties;
and

WHEREAS, To clarify this situation for certain counties, and
to make this situation more equitable, this Act is intended to
amend the current law in appropriate ways; now, therefore,
