Ch. 11

LAWS OF MARYLAND

DRAFTER'S NOTE: This corrects an outdated cross-reference
in Article 64A, § 12-I(d)

The provisions of Article 76A relating to the
confidentiality of records became Title 10, Subtitle 6
of the State Government Article in Ch. 284 of the Acts
of 1984.

The outdated cross-reference was noted by the Michie
Company.

17.

(b) The list of eligibles for each class of position in the
classified service shall be made up first of names [and] OF
persons who have previously held positions in such class and who
were laid off in good standing under § 35 of this article, and
then of names of persons in the order of merit who have been
examined by the Secretary and found qualified.

DRAFTER'S NOTE: This corrects a typographical error in
Article 64A, § 17(b).

The typographical error, the use of the conjunction
"and" in the place of preposition "of", was a
publishing error and occurred in the publication of
the 1972 Replacement Volume, for Volume 5B of the
Annotated Code.

The typographical error was noted by the Computer
Division of the Department of Legislative Reference.

22.

(a) The Secretary of Personnel shall prepare a list of
eligibles consisting of the names of persons whose general
average and whose marks on any part of the examination exceed the
minimum set by the rules of the Secretary and shall publicly post
such list in his office. Eligible lists shall continue in force
for one year from the date of posting and may be extended by the
Secretary by action taken before the expiration of such year, and
entered in the minutes, provided, however, that the Secretary[,]
shall have power at any time, after a public hearing and notice
as prescribed by § 20 of this article, to cancel the whole or any
part of any eligible list by reason of illegality or fraud in
connection therewith. The Secretary shall also have the power,
in his discretion, to remove the name of any person from an
eligible list for any wilful misrepresentation of a material
matter made in an application for examination to establish an
eligible list. A new eligible list for any class shall be
combined with an existing list as the Secretary may by rules
provide but in such case any portion of such combined list shall
be automatically cancelled one year after being first posted
