2.  NOT USED PRIMARILY FOR HIGHWAY
TRANSPORTATION OF PEOPLE OR PROPERTY; AND

3.  OPERATED OR MOVED ON A HIGHWAY ONLY AS
AN INCIDENT TO ITS NONHIGHWAY USE; AND

(II) THE FARM VEHICLE'S EQUIPMENT IS

MECHANICALLY OR HYDRAULICALLY DRIVEN BY THE INTERNAL COMBUSTION
ENGINE THAT PROPELS THE FARM VEHICLE. THE FARM EQUIPMENT HAS
EQUIPMENT ON IT THAT IS MECHANICALLY OR HYDRAULICALLY DRIVEN BY
THE INTERNAL COMBUSTION ENGINE THAT PROPELS THE FARM EQUIPMENT.

(b) The refund shall be a percent of the tax on motor
vehicle fuel as follows:

(1)  10 percent from July 1, 1986 through June 30,
1987;

(2)  18 percent from July 1, 1987 through June 30,
1988; and

(3)  25 percent beginning on July 1, 1988 through June
30, 1989.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
be construed retroactively and shall be applied to and
interpreted to affect all taxable years beginning on or after
July 1, 1986.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
