AN ACT concerning

Criminal Law - Death Penalty - Incompetent Inmates

FOR the purpose of prohibiting the State from executing the death
sentence against an incompetent inmate; defining certain
terms; establishing procedure by which an inmate may be
determined by a court to be competent or incompetent;
providing for revocation of a warrant to execute a death
sentence and reduction of sentence when an inmate is found
to be incompetent; providing for exclusive and discretionary
judicial review by the Court of Appeals of a circuit court
order regarding competency or incompetency; establishing
procedures for redetermination of an inmate's competence;
requiring the Court of Appeals to adopt certain rules;
providing for the construction and applicability of this
Act; clarifying language; and generally relating to
imposition of the death penalty on incompetent inmates.
