(a) The Nature Conservancy may submit to the Department a
proposal outlining an area in which the Nature Conservancy, in
cooperation with or on behalf of the St. Mary's City Commission,
has secured or is considering securing title or other legal
interest. The proposal shall include the location, acreage,
explanation of planned use, and explanation of values which make
the acreage of interest to the State.
(b) Within three months after receipt of the proposal, the
Secretary [of Economic and Community Development] shall report to
the Nature Conservancy his recommendations as to the suitability
or nonsuitability of the proposal in relation to the aims of the
St. Mary's City Commission, with copies to the Board of Public
Works, the President of the Senate, and the Speaker of the House
of Delegates.
(c) Notwithstanding the provisions of Part III of Title 4,
Subtitle 4 of the State Finance and Procurement Article, and
subject to the availability of funds and in accordance with other
provisions of this article regarding the St. Mary's City
Commission, the Secretary [of Economic and Community Development]
may enter into agreements with the Nature Conservancy for the
State to acquire title to or an interest in property owned by the
Nature Conservancy or property on which the Nature Conservancy
holds an option or a contract to purchase.
Subtitle [2.] 3. Commission on Afro-American
History and Culture

[(a)] 5-301. The Commission on Afro-American History and
Culture is [created as] a part of the Department [of Economic and
Community Development]. [It] IN THIS SUBTITLE, IT shall be
referred to as the "Commission."
[(b) (1)] 5-302. (A) The Commission shall consist of nine
members appointed by the Governor with the advice and consent of
the Senate for terms of 4 years each. The terms of members are
staggered as required by the terms provided for members of the
Commission on July 1, 1985.
[(2)] (B) Any Commissioner may be reappointed, except
that any Commissioner who has served two consecutive 4 year terms
may not be reappointed until at least 1 year after the expiration
of that Commissioner's prior tenure.
[(3)] (C) If for any reason a Commissioner fails to
serve or complete any term, the Governor with the advice and
consent of the Senate, shall appoint a successor to serve for the
remainder of the term.
