(ii) Except for instant bingo, in Baltimore
County, bingo is governed by § 252 of this article.

(iii) In Baltimore County, notwithstanding any
regulations to the contrary, instant bingo need not be offered in
conjunction with other customary bingo games.

(4) (i) In Baltimore County, any organization which
operates a carnival, bazaar, or raffle under this section shall
first obtain a permit which provides that [such] THE carnival,
bazaar, or raffle shall be managed AND OPERATED personally only
by the members of the organization and the permit shall not be
transferable.

(II) THE PERMIT APPLICATION SHALL BE MADE ON
FORMS PROVIDED BY THE DEPARTMENT OF PERMITS AND LICENSES AND
SHALL CONTAIN:

1. AN AFFIDAVIT THAT NO PERSON OR LEGAL
OR BUSINESS ENTITY WILL RECEIVE ANY FEE OR COMPENSATION FOR
MANAGING OR OPERATING A GAMING DEVICE AT THE CARNIVAL, BAZAAR, OR
RAFFLE; AND

2. ANY ADDITIONAL INFORMATION THAT THE
DEPARTMENT OF PERMITS AND LICENSES MAY REQUIRE.

(III) THE DEPARTMENT OF PERMITS AND LICENSES
MAY CHARGE A FEE FOR THE PERMIT. THE ADMINISTRATIVE OFFICER OF
BALTIMORE COUNTY SHALL DETERMINE THE AMOUNT OF THE FEE.

[((ii)] (IV) Only those bona fide volunteer
fire, religious, fraternal, civic, veterans, veterans' hospital,
amateur athletic, or charitable organizations or corporations
shall be eligible for a permit under this paragraph which spend
[the greater part] 75 PERCENT of their [net] GROSS
proceeds from operating a carnival, bazaar, or raffle for
volunteer fire, religious, fraternal, civic, veterans, veterans'
hospital, amateur athletic, or charitable purposes in Baltimore
County.

(5) (I) THIS PARAGRAPH APPLIES TO BALTIMORE COUNTY.

(II) ANY GAMING DEVICE USED AT THE CARNIVAL,
BAZAAR, OR RAFFLE SHALL BE OPERATED WITHOUT THE ASSISTANCE OF
PROFESSIONALS AND ONLY BY MEMBERS OF THE ORGANIZATION THAT DO NOT

REGULARLY CONDUCT ANY SIMILAR ACTIVITIES FOR ANY OTHER

ORGANIZATION.

(III) ANY PERSON OR LEGAL OR BUSINESS ENTITY
MAY NOT RECEIVE ANY FEE OR COMPENSATION FROM THE ORGANIZATION FOR
MANAGING OR OPERATING A GAMING DEVICE AT THE CARNIVAL, BAZAAR, OR
RAFFLE.
