substantial construction or rehabilitation of low income [rental]
housing.

(b)  Priority shall be given to applicants who have
experience in developing low income housing and who bring
additional financial or technical resources to the project.

(c)  The Corporation shall consider, in approving
applications for awards as provided under this subtitle:

(1)  The extent to which the proposed project will
provide housing for the lowest income groups;

(2)  Regional cost variations, variations in the size
of units, and services which will be included in the [rentals]
HOUSING;

(3)  The number and percentage of low income [rental]
households in the county or municipality; and

(4)  The quantity and condition of low income [rental]
housing in the county or municipality.

13-613.

(a)  (1) Any individual who fraudulently obtains, attempts
to obtain, or aids another person in fraudulently obtaining or
attempting to obtain any award to which the individual is not
entitled from the Maryland [Rental] Housing Resource Program is
guilty of a misdemeanor.

(2) For purposes of this section, fraud includes:

(i) Willfully making a false statement or
representation; or

(ii) Willfully failing to disclose a material
change in financial condition; or

(iii) Impersonating another person.

(b)  On conviction, after notice and the opportunity to be
heard as to the amount of restitution due and how restitution is
to be made, the individual shall:

(1)  Make full restitution of the value of the award
unlawfully received; and

(2)  (i) Be fined not more than $10,000;

(ii) Imprisoned for not more than 3 years; or
(iii) Both.
