Ch. 306

LAWS OF MARYLAND

of Dangerous Household Substances; and Title 24. Miscellaneous
Provisions, respectively of Article - Health - General of the
Annotated Code of Maryland.

SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

ARTICLE - ENVIRONMENT

1-101.

(c) "Department" means the Department of [Health and Mental
Hygiene] THE ENVIRONMENT.

(h,) "Secretary" means the Secretary of [Health and Mental
Hygiene] THE ENVIRONMENT.

1-301.

(A)  The Secretary shall carry out and enforce the
provisions of this article and the rules and regulations adopted
under this article.

(B)  THE SECRETARY MAY DELEGATE DUTIES, POWERS, AND
FUNCTIONS AS PROVIDED IN THIS ARTICLE TO A HEALTH OFFICER FOR A
COUNTY OR OTHER TO ANOTHER COUNTY OFFICIAL AUTHORIZED TO
ADMINISTER AND ENFORCE ENVIRONMENTAL LAWS.

(C) IN THOSE COUNTIES WHERE A COUNTY OFFICIAL OTHER THAN
THE HEALTH OFFICER IS AUTHORIZED TO ADMINISTER AND ENFORCE STATE
ENVIRONMENTAL LAWS UNDER THIS SECTION, THE COUNTY SHALL ESTABLISH
MINIMUM QUALIFICATIONS FOR THAT COUNTY OFFICIAL THAT INCLUDE
STANDARDS OF EDUCATION AND EXPERIENCE RELATED TO ENVIRONMENTAL
ISSUES.

SUBTITLE 4. ORGANIZATION AND GENERAL AUTHORITY OF DEPARTMENT

1-401.

THERE IS A DEPARTMENT OF THE ENVIRONMENT, ESTABLISHED AS A
PRINCIPAL DEPARTMENT OF THE STATE GOVERNMENT.

1-402.

(A)  THE HEAD OF THE DEPARTMENT IS THE SECRETARY OF THE
ENVIRONMENT, WHO SHALL BE APPOINTED BY THE GOVERNOR WITH THE
ADVICE AND CONSENT OF THE SENATE.

(B)  (1) THE SECRETARY SERVES AT THE PLEASURE OF THE
GOVERNOR AND IS RESPONSIBLE DIRECTLY TO THE GOVERNOR. THE
SECRETARY SHALL ADVISE THE GOVERNOR ON ALL MATTERS ASSIGNED TO
