issuing or renewing a permit to operate a landfill or
landfill system; requiring the Department to adopt certain
regulations under this Act; requiring an applicant for a
permit or renewal of a permit to operate a landfill or
landfill system to disclose certain information; permitting
the Department of Health and Mental Hygiene to deny the
issuance of certain landfill permits under certain
conditions; permitting the Department of Health and Mental
Hygiene to revoke or refuse to renew certain landfill
permits under certain conditions; providing a special
provision for the codification of this Act; and generally
relating to the issuance or , renewal, revocation, or denial
of permits to operate a landfill or landfill system.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - Environmental

9-212.1.

(A) BEFORE THE DEPARTMENT ISSUES OR RENEWS A PERMIT TO
OPERATE A LANDFILL OR A LANDFILL SYSTEM, THE DEPARTMENT MUST TAKE
INTO CONSIDERATION WHETHER THE APPLICANT HAS VIOLATED OR HAS A
PATTERN OF VIOLATIONS OF THIS SUBTITLE OR ANY REGULATION ADOPTED
UNDER THIS SUBTITLE.

(B) THE DEPARTMENT SHALL ADOPT REGULATIONS TO REQUIRE
APPLICANTS FOR A PERMIT OR A RENEWAL OF A PERMIT TO OPERATE A
LANDFILL OR A LANDFILL SYSTEM TO DISCLOSE WHETHER THE APPLICANT
HAS EVER VIOLATED THIS SUBTITLE OR ANY REGULATION ADOPTED UNDER
THIS SUBTITLE.
