3-107.

The Secretary of State shall keep for public examination a
record of all marks registered, or renewed under this [subheading]
SUBTITLE.

DRAFTER'S NOTE: This corrects outdated cross-references in
Article 41, §§ 3-104(a) and (c), 3-105(e) and (f),
3-106, and 3-107.

Former subheading "Trademarks and Service Marks"
became Title 3, Subtitle 1 of this article when the
sections of Article 41 were renumbered pursuant to, Ch.
5 of the Acts of 1986.

The outdated cross-references were noted by the Michie
Company.

3-108.

The Secretary of State shall cancel from the register:

(1)  After one year from June 1, 1954, all
registrations under prior acts which are more than ten years old
and not renewed in accordance with this [subheading] SUBTITLE;

(2)  Any registration concerning which the Secretary
of State shall receive a voluntary request for cancellation
thereof from the registrant or the assignee of record;

(3)  All registrations granted under this [subheading]
SUBTITLE and not renewed in accordance with the provisions
hereof;

(4)  Any registration concerning which a court of
competent jurisdiction shall [find] FIND THAT:

[(a) That the] (I) THE registered mark has
been abandoned[,];

[(b) That the] (II) THE registrant is not the
owner of the mark[,];

[(c) That the] III) THE registration was
granted improperly[,];                                      

[(d) That the] (IV) THE registration was
obtained fraudulently[, ]; OR
