16-402.

(a) After the conviction of an individual   for a violation

of Article 27, § 388 or § 388A of the Code,   or of the vehicle

laws or regulations of this State or of any     local authority,

points shall be assessed against the individual   as of the date of
violation and as follows:

(6) Driving after suspension of license under the
provisions of § 17-106, § 26-204, § 26-206, or § 27-103 of this
article..................................................3 points

(21)  Driving after refusal, suspension, cancellation,
or revocation of license except for suspensions of license under
the provisions of § 17-106, § 26-204, § 26-206, or § 27-103 of
this article............................................12 points

(22)  Any violation of [Subtitle 3] §§ 16-301 AND
16-302 of this title [,except §§ 16-304 and 16-305].....12 points

27-101.

(c) Any person who is convicted of a violation of any of
the provisions of the following sections of this article is
subject to a fine of not more than $500 or imprisonment for not
more than 2 months or both:

(12) § 16-303[(b)] (H) ("Driving while under certain
suspensions");

(h) Any person who is convicted of a violation of any of
the provisions of § 15-502(a) of this article ("License
required"), § 16-303(a), (B), (C), (D), (E), (F), OR (G) of this
article ("Driving while [privilege] LICENSE is canceled,
suspended, refused, or revoked"), § 17-107 of this article
("Prohibitions"), § 21-902(a) of this article ("Driving while
intoxicated"), or § 21-904 of this article ("Fleeing or eluding
police") is subject to:

(1)  For a first offense, a fine of not more than
$1,000 or imprisonment for not more than 1 year or both; and

(2)  For any subsequent offense, a fine of not more
than 51,000 or imprisonment for not more than 2 years or both.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and having
been passed by a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the General
Assembly, it shall take effect from the date of its passage.
