CHAPTER 235

(House Bill 883)

AN ACT concerning

Motor Vehicle Fuel Tax Law - Statute of Limitations

FOR the purpose of extending the statutory time limitation on
criminal prosecutions of violations of the Motor Vehicle
Fuel Tax Law.

BY adding to

Article - Courts and Judicial Proceedings

Section 5-106(i)

Annotated Code of Maryland

(1984 Replacement Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

5-106.

(I) A PROSECUTION FOR AN OFFENSE UNDER THE MOTOR VEHICLE
FUEL TAX LAW, ARTICLE 56, SECTIONS 135 THROUGH 157N OF THIS CODE
SHALL BE INSTITUTED WITHIN 3 YEARS AFTER THE OFFENSE WAS
COMMITTED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
