(K) NOTWITHSTANDING ANY DECISION OF THE COMMISSION MADE
BEFORE JANUARY 1, 1986, OR ANY OTHER PROVISION OF THIS ARTICLE,
THE COMMISSION MAY NOT DENY A CERTIFICATE OF NEED APPLICATION
FROM ANY PERSON WHO APPLIED TO THE COMMISSION BEFORE JANUARY 1,
1986 TO CONSTRUCT A GENERAL HOSPITAL, AS DEFINED IN § 19-307 OF
THIS TITLE, IF:

(1) THE HOSPITAL IS PROPOSED TO BE LOCATED IN A
COUNTY WHERE NO GENERAL HOSPITAL EXISTS;

(2) BEFORE JANUARY 1, 1986, THE LOCAL GOVERNING BODY
OF THE COUNTY PASSED A RESOLUTION FINDING A PUBLIC NEED FOR THE
GENERAL HOSPITAL TO BENEFIT THE RESIDENTS OF THE COUNTY; AND

(3) THE LOCAL GOVERNING BODY OF THE COUNTY

RECOMMENDED THAT THE COMMISSION ISSUE A CERTIFICATE OF NEED TO
THE PERSON.

FOR the purpose of requiring the Secretary of Health and Mental
Hygiene, in cooperation with the State Health Resources
Planning Commission, to make an assessment of health care
deficiencies in Worcester County; establishing the criteria
and scope of the assessment; requiring the Secretary to
report to the Joint Committee on Health Care Cost
Containment, as established by Chapter 111 of the Acts of
the General Assembly of 1985, on or before a certain date;
requiring an additional report to the General Assembly on a
certain date; generally relating to an assessment of health
care needs in Worcester County; and making this Act an
emergency measure.

BY repealing and reenacting, without amendments,
