38.
(c.) Where the employer has been given notice, or the
employer, or his designated representative in the place where the
injury occurred, has knowledge of any injury or death of an
employee, and the employer fails, neglects or refuses to file a
report thereof, as required by the provisions of subsection (b)
of this section, the limitations prescribed by this article shall
not begin to run against the claimant or any person entitled to
compensation until such report shall have been furnished as
required by subsection (b) of this section. This section shall
not apply to an "employee" as defined by [§ 67(4)] § 67(3) OF
THIS ARTICLE.
DRAFTER'S NOTE: This corrects an outdated cross-reference
and corrects a stylistic error in Article 101, §
38(c).
Article 101, § 67(4) became § 67(3) in Ch. 502 of the
Acts of the General Assembly of 1972. The stylistic
error (the omission of "of this article") occurred in
Ch. 742 of the Acts of the General Assembly of 1968.
The stylistic error was noted by the professional

Any employee entitled to receive compensation under this
article is required, if requested by the Commission to submit
himself for medical examination at a time and from time to time
at a place reasonably convenient for the employee and as may be
provided by the rules of the Commission. If the employee
[refuse] REFUSES to submit to any such examination, or obstructs
the same, his right to compensation shall be suspended until such
examination has taken place, and no compensation shall be payable
during or for account of such period.
