(3) Facilitate the perpetration of fraud.
(c) The specifications, tolerances, and other technical
requirements for commercial weighing and measuring devices,
specified in § [11-209] 11-204, shall be those adopted by the
National Conference on Weights and Measures and included in the
National Bureau of Standards Handbook 44, as amended. These
specifications, tolerances, and other technical requirements
shall remain in effect unless modified or rescinded by a rule or
regulation adopted by the Secretary.
(d) For the purposes of this title, a weight and measure is
correct when it conforms to all applicable requirements
promulgated as specified in this section. A nonconforming weight
and measure is incorrect.
(e) Until January 1, 1993, the Secretary may not adopt
regulations requiring display of the total cost for the amount
purchased on any stationary, computing device which dispenses
gasoline, gasohol, kerosene, or diesel fuel if:
(1) The business where the device is located did not
dispense more than 120,000 gallons of fuel in any calendar year
from July 1, 1983;
(2) The device was installed at the business location
before January 1, 1983;
(3) The business produces evidence to the Secretary
of the amount dispensed;
(4) The computing device is set to compute at
one-half the price per gallon; and
(5) The pricing and information guidelines
established by the Secretary in the notice of May 31, 1979 are
met.

(a) At least every two years, the Secretary shall test the
secondary standards of weights and measures provided by any city
or county permitted to appoint a local inspector of weights and
measures under this title. He shall approve those found to be
correct and reject those found to be incorrect.
(b) The Secretary shall inspect the secondary standards to
insure their accuracy and acceptability, as often as he deems
necessary but at least once every year.]

(a) Upon the request of any competent State authority, the
Secretary may inspect and test any weight and measure.
